Association Governing Documents
Every REALTOR® Member of the Association has a duty and responsibility
to abide by the Code of Ethics, as well as the Constitution, Bylaws
and Rules and Regulations of the Association, and the Constitution
and Bylaws of N.A.R. and C.A.R. The responsibility relating to enforcing
the Code of Ethics, disciplining Members, and arbitrating disputes
is governed by the Code of Ethics and Arbitration Manual of N.A.R.,
to the extent consistent with state law.
Duty to Arbitrate
By becoming and remaining a Member, every REALTOR® Member agrees
that all disputes with any other Association Member or member of
the public will be submitted to arbitration through the Association.
The membership application is a binding arbitration agreement. If
a Member resigns or otherwise causes membership to terminate, the
duty to submit to arbitration continues in effect even after membership
lapses or is terminated, provided that the dispute arose while the
former member was a REALTOR®.
Discipline Proceedings
Any Member of the Association may be reprimanded, fined, placed on
probation, suspended, or expelled by the Board of Directors for
a violation of the Association's Bylaws and Rules and Regulations,
after a hearing. Any REALTOR® Member of the Association may be
disciplined by the Board of Directors of the Association for violations
of the Code of Ethics or other duties of membership, after a hearing.
Non-REALTOR® Members
Although non-REALTOR® Members are not subject to the Code of Ethics
or its enforcement by the Association, such Members are encouraged
to abide by the principles established in the Code of Ethics and
conduct their business and professional practices accordingly. Non-REALTOR® Members
may, upon recommendation by a hearing panel of the Professional Standards
Committee, be subject to discipline for any conduct which reflects
adversely on the terms REALTOR® or REALTORS®, and the real estate
industry, or for conduct that is inconsistent with or adverse to
the objectives and purposes of the Association, C.A.R. and N.A.R.
